The Labour Court varied a Rights Commissioner's compensation recommendation after William Todd & Company Limited appealed a claim over a worker's reduced commission following a transfer to menswear. The decision was signed on 30 April 1997.
The Rights Commissioner had recommended compensation based on two years of commission earnings. The company argued that commission varied between departments and that compensation could limit staff transfers. Mandate said the worker's earnings fell after his transfer from the Hi-Fi and Electrical Department.
The Court said actual loss of earnings was difficult to establish and did not uphold the compensation recommendation. It instead recommended a £950 ex-gratia payment in full and final settlement, taking account of the worker's time in the Hi-Fi Department.
