In 1996, the Labour Court rejected the Services Industrial Professional Technical Union’s appeal and upheld a Rights Commissioner’s recommendation that Iarnrod Eireann pay a worker £100 ex gratia. The decision was dated 6 February 1996. The worker had been re-employed as a helper after illness left him permanently unfit to drive. He had previously carried out working foreman duties and lost the associated differential when another driver continued in the role. The union argued he could perform the duties as a helper and that the company had handled his removal poorly. Iarnrod Eireann said the helper role left no suitable time for the additional work.
