The Labour Court rejected the National Bus and Rail Union’s appeal over a worker’s claim for payment for the October 1995 Bank Holiday. The decision was signed on 21 November 1996. The union said buses at Bus Eireann’s Monaghan depot needed refuelling and cleaning that day, work normally done by the engineering operative, and argued he should have been rostered. Bus Eireann said he received a paid day off and was treated like similarly graded staff. The Court said public-holiday rostering was at the company’s discretion and found no grounds to justify payment for the day.
