Labour Court rejects union appeal over Aer Lingus kitchen porter dismissal

In 1996, the Labour Court rejected the Services Industrial Professional Technical Union’s appeal over the dismissal of a temporary kitchen porter at Aer Lingus, upholding the Rights Commissioner’s recommendation that his unfair-dismissal claim fail. The decision was signed on 19 August 1996. The union argued that seasonal workers were laid off on a first-in, last-out basis and that the worker had longer service than some colleagues who remained employed. Aer Lingus said his temporary contract had been honoured. The Court said there was no formal agreement between the parties on seniority in lay-offs.
