The Labour Court amended a Rights Commissioner’s recommendation in Sutcliffe Catering Services’ appeal, directing that the recommended rate be applied to a worker on a “red circled” basis. The decision was dated 29 July 1996. The Rights Commissioner had recommended restoring the worker’s Pelican House hourly rate, subject to national agreements, from 13 September 1995. Sutcliffe said she had accepted different terms when moving to Bank of Ireland Head Office. The Services Industrial Professional Technical Union argued that her employment had been continuous and her previous rate should continue.
