In 1996, the Labour Court varied a Rights Commissioner's £1,000 recommendation to a £300 payment to a worker after finding Moore Enterprises Limited had met its obligations under the Transfer of Undertakings Regulations. The decision was signed on 29 March 1996. The worker had been a cleaner for three years at a Donnybrook site. After Moore Enterprises Limited took over the cleaning contract, it removed the morning shift, reducing his hours by two a day. The company said it offered alternative work with the same hours, first at the same site and later elsewhere; the worker rejected both offers. The Services Industrial Professional Technical Union argued that the reduction breached the Regulations. The Court said the company's efforts met its obligations, but found an apparent misunderstanding about its first offer of extra hours warranted an ex-gratia payment.
