In 1996, the Labour Court upheld Delphi Packard Electric Systems Ireland Limited’s appeal and changed a Rights Commissioner’s recommendation on banked hours. The decision was dated 26 March 1996. The dispute involved an agreement extending the working week from 39 to 41 hours, with the extra two hours banked for later use. The Amalgamated Transport and General Workers Union and Services Industrial Professional Technical Union sought banked hours during annual leave, as the Rights Commissioner had recommended. Delphi argued employees accrued the hours only by working the extra time. The Court ruled that the extra two hours should not be banked when a worker took a full week of annual leave. The existing arrangement for odd days off was to continue. The Court did not uphold the Rights Commissioner’s recommendation and upheld the company’s appeal.
