The Labour Court gave two Tytex Ireland Limited workers an opportunity to provide assurances about their future behaviour after the Services Industrial Professional Technical Union appealed their unpaid suspensions. The decision was dated 4 December 1995. The dispute followed a work stoppage involving four workers on 26 July 1994. The Union said the plant’s telephone was out of order and machinery had been shut down for safety; the company disputed that there was an emergency and said the stoppage caused an unrecoverable production loss. The Rights Commissioner had recommended that the workers’ claim fail and that their records be cleared 12 months after the suspensions were served. The Labour Court said management should allow them to give assurances in line with those given by the other employees involved; if management did not accept this, the Rights Commissioner’s recommendation would stand.
