In 1995, the Labour Court varied a Rights Commissioner's recommendation in a dismissal dispute involving the County Tipperary North Riding Vocational Educational Committee and the Teachers' Union Of Ireland. The Court's decision was signed on 15 May 1995.
The Teachers' Union Of Ireland appealed on behalf of a temporary part-time literacy/numeracy tutor at the Youthreach Centre in Roscrea, seeking his reinstatement. The Committee said the position had been filled through a public competition and denied manipulating the selection process.
The Court found no basis to uphold either side's appeal but amended the recommendation. The Committee was to pay an ex-gratia sum equal to the gross income the worker would have received from 5 November 1993 to 17 January 1994.
