In 1994, the Labour Court partly allowed Iarnrod Eireann’s appeal over overtime for a platelayer. In a decision dated 22 December 1994, it determined that the company should provide the equivalent of one day’s overtime, provided the worker worked the time. The worker, part of a mobile repair gang at Connolly Station, was not called for overtime during rail repairs at Glasnevin Junction in June 1993. The Rights Commissioner had recommended payment equivalent to the overtime the worker would have earned. The National Bus And Rail Union argued he was available and should have been included under an agreed overtime-sharing procedure. Iarnrod Eireann said overtime was allocated by seniority and availability.
