The Labour Court rejected Keanes Pharmacy’s appeal and left a £1,000 separation package for a worker in place. The Court signed its decision on 9 May 1994. Keanes Pharmacy made the worker redundant after a decline in business. The Rights Commissioner recommended the package, inclusive of statutory payments. The employer argued that the redundancy was genuine and the amount excessive for its small business. The Services Industrial Professional Technical Union said the worker had four years’ service and that £1,000 was the minimum settlement warranted.
