In 1994, the Labour Court rejected Barry's Hotel's appeal and upheld a Rights Commissioner's recommendation to apply the sick-pay scheme to a cleaner. The recommendation provided six weeks at half pay and six weeks at quarter pay. The decision was signed on 16 May 1994.
The hotel argued the scheme covered bar staff and that there was no agreement to pay sick pay during the cleaner's absence. Mandate said the worker was covered by the scheme, had supplied sickness certificates and was entitled to its benefit; it also said other staff had received sickness benefit.
