In 1993, the Labour Court rejected the Irish Distributive And Administrative Trade Union’s appeal and upheld the Rights Commissioner’s recommendation that Penneys transfer a cashier from the cash office to the shop floor, with a review of her position six months after the transfer. The decision was dated 23 September 1993.
The dispute followed a transaction in which the cashier put a £9,000 sterling cheque payable to herself into a store bank lodgement and removed £9,105.63 in cash. The union argued the transfer was excessive because the company suffered no financial loss and did not question her honesty. Penneys said she breached its lodgement procedures, issued a final written warning and kept her pay and conditions unchanged. The Court found the recommendation was not unreasonable.
