In 1993, the Labour Court rejected an assistant manager’s appeal and upheld a £3,500 recommendation against Tralee Super Bowl after his dismissal during probation. The Court recommended that the amount be paid in two equal instalments, due six and 12 months after the decision, in view of the company’s ability-to-pay submission. The decision was dated 21 June 1993. The worker argued that the recommendation was insufficient, citing unemployment, the emotional effect of the dismissal and damage to his reputation. The company said a six-month probation period applied and cited performance and operational difficulties.
