In 1993, the Labour Court upheld a recommendation that a worker's claim concerning his transfer from the night shift should fail. The decision was signed on 26 January 1993. The worker argued that his overall service with Packard Electric Ireland Limited, rather than his time on the night shift, should have determined selection. He sought the earnings difference for the period he said he should have remained on nights. The company said the arrangement for removing workers from night shift had been agreed with the union and accepted by both parties. The Rights Commissioner had found that the company acted in good faith and in accordance with established practice; the Labour Court decided that recommendation should stand.
