In 1992, the Labour Court upheld a Rights Commissioner's recommendation that Amalgamated Transport And General Workers' Union's claim over a worker's return to work should fail. The Court's decision was signed on 13 October. The union argued that a cleaning position was available which did not involve driving or machinery. Cadbury Ireland P.L.C. said the worker was not fit to resume work and that employees had to be capable of performing the full range of duties for available jobs. The Court said granting the claim would conflict with the company's staff-flexibility policy and the need to ensure fitness for those duties.
