In 1991, the Labour Court varied the disciplinary outcome in H.B. Ice Cream Limited’s appeal over a fitter’s dismissal. The decision was dated 26 November 1991. The Court found the worker had tried to falsify his attendance record and that his serious misconduct could justify dismissal. It imposed a two-month unpaid suspension, a final written warning covering the next two years and a requirement to clock in and out when entering or leaving the premises. H.B. Ice Cream argued that the worker had misrepresented his hours to claim overtime. The Amalgamated Engineering Union said he had left for family business and did not intend to defraud the company. The Court considered his 13½ years of satisfactory service when setting the penalty.
