The Labour Court rejected the Amalgamated Engineering Union’s appeal against a Rights Commissioner’s recommendation that a worker’s loss-of-earnings claim against Irish Rail fail. The Court found the recommendation was not unreasonable and noted Irish Rail’s offer of shift work at Connolly Station remained open. The decision was signed on 23 February 1989. The union argued the worker had suffered substantial earnings losses and sought compensation under a company formula. Irish Rail said he could have retained his previous earnings by accepting shift work. The Court said the company was prepared to assess and compensate any resulting loss under an agreed formula.
