In 1988, the Labour Court upheld Dublin County Council’s appeal against a Rights Commissioner’s recommendation concerning overtime for a redeployed foreman/craftsman. The decision was signed on 8 April 1988. The National Union Of Woodworkers And Woodcutting Machinists argued that the worker remained in the same grade and did similar work after moving from road construction to road maintenance. The Council said the July 1987 agreement did not cover redeployment caused by a financial shortfall and opposed paying for overtime he had not worked. The Court found the agreement did not cover that situation, overturning the earlier recommendation to restore overtime.
