The Labour Court partly upheld Donegal County Council’s appeal, keeping a recommendation to place a worker on the Assistant Engineer salary scale from 1 January 2015 but setting aside the €2,000 compensatory payment. The decision was signed on 14 April 2016. The worker, represented by the Services Industrial Professional Technical Union, had remained on the Graduate Engineer scale for 11 years. The union said he had worked at Assistant Engineer level. The Council argued that appointments to higher posts required competitive selection and that progression had been restricted by the moratorium.
