The Labour Court upheld the Rights Commissioner’s recommendation that Geraldine Holden was on the correct point of the Hospital Attendant scale, rejecting her appeal. The decision was signed on 25 March 2015. Holden, represented by the Services Industrial Professional Technical Union, argued she should have been placed on the higher Multitask Attendant scale after returning from sick leave. HSE South said she remained in catering on medical advice and had not been cleared for other duties. The Court found management had followed the medical advice and Holden had not indicated she was certified and available for Multitask Attendant duties. The Court recommended that, if Holden met the criteria for the role, she be given every opportunity to apply for a Multitask Attendant vacancy.
