The Labour Court recommended that Shaws Department Store reinstate a worker as a supervisor and repay the pay and bonus difference accrued until the recommendation is implemented. The decision was signed on 30 November 2015. The worker, represented by Mandate, was demoted to sales assistant and given a written warning after an incident at the store’s Drogheda shop. Two colleagues involved received written warnings only. The Court found the demotion disproportionate and the incident at the less serious end of inappropriate behaviour. It also said the employer’s representative could not convincingly explain whether alternative sanctions had been considered.
