The Labour Court rejected Marie Quigley’s appeal against her transfer from the HSE to the Child & Family Agency T/A Tusla, upholding the Rights Commissioner’s recommendation against rescinding it. The decision was signed on 5 November 2015. Quigley sought to return to her HSE role. Her union, the Irish Municipal, Public and Civil Trade Union, argued that she did not spend 80% of her time in pre-school services, that a colleague had been allowed to remain in the HSE, and that recruitment could create an opportunity for her return. Tusla said her fully funded children’s services post was identified for transfer under the Framework Agreement. The Court upheld management’s right to transfer her. It noted that her application to return would be considered under Tusla’s transfer policy if a suitable vacancy arose.
