The Labour Court upheld a worker’s appeal over a first written warning and set aside the Rights Commissioner’s recommendation. The decision was signed on 3 July 2015. The worker’s union argued that the warning had been announced before the disciplinary meeting ended and that the process was unfair. Dublin Street Parking Services said the worker had failed to meet performance targets and that the process and sanction followed company procedures. The Court acknowledged management’s right to manage underperformance before allowing the appeal in the circumstances of the case.
