The Labour Court amended a recommendation on travel expenses in an appeal by a worker at HSE West over reassignment. It left the rest of the recommendation in place, including its rejection of reinstatement as Critical Incident Response co-ordinator. The decision was signed on 30 March 2015. The worker had sought reinstatement and travel expenses under HSE policy. HSE West said workplace relationships had deteriorated and the new role suited the worker’s grade and salary. The Court said assigning duties within the worker’s terms and conditions rested with the employer, and accepted that the reassignment did not breach the contract or a collective agreement. It amended the travel-expenses recommendation to reflect established regulations.
