Labour Court affirms recommendation in Tesco worker’s premium overtime dispute

The Labour Court affirmed a Rights Commissioner’s recommendation in a Tesco Ireland Ltd worker’s claim for premium overtime pay. The recommendation called for Tesco to address a wider pay-rate issue with the union and, if it remained unresolved after three months, calculate and pay appropriate back pay from 1 November 2014. The decision was signed on 27 March 2015. The worker said overtime had been paid at the standard rate. Tesco argued that a wider issue over the basic rate needed to be resolved before any amount due could be calculated, and that a 6% overpayment exceeded the amount claimed. The worker had appealed the recommendation.
