The Labour Court upheld a Rights Commissioner’s recommendation in a Dublin City Council worker’s claim for Accident Sick Pay Scheme benefits, and the worker’s appeal failed. The Court found that management breached the scheme by refusing immediate payment before the assessment, but said the claim was moot because the later assessment found her fit for full duties and management would have been entitled to recoup any payment. The decision was signed on 30 March 2015. The worker sought benefits for an absence from 16 July to 18 October 2011. The Rights Commissioner had found the claim not well founded; the Labour Court upheld that recommendation for different reasons.
