Labour Court upholds Analog Devices workers’ verbal warnings

The Labour Court upheld verbal warnings given to two workers at Analog Devices International, but ruled that the expired sanctions should not be reinstated. The decision was signed on 14 November 2014. The company had appealed Rights Commissioner recommendations to rescind the warnings, issued after the workers were in a room where another staff member watched a DVD using company technology. The Services Industrial Professional Technical Union said the workers were on an official break and were not actively involved in watching it. The company said they knew personal use of its technology was prohibited. The court found the warnings reasonable and proportionate. It noted that they had expired and were no longer of consequence, and decided they should not be retrospectively reinstated.
