The Labour Court granted a worker access to Iarnrod Eireann’s Staff Superannuation Scheme, with service credit from 16 November 2012. Its decision was signed on 10 November 2014. The worker, represented by the Services Industrial Professional Technical Union, appealed a Rights Commissioner recommendation that his claim fail. He said Iarnrod Eireann had not transferred him to the scheme as agreed. The company said access depended on resolving an underfunding issue and argued the claim was out of time. The court found the worker was correctly graded and properly paid, but said he should not be denied scheme access because he had passed age 55 before the Rule 29(b) dispute was resolved. Access is subject to the terms ultimately agreed in that dispute.
