The Labour Court rejected Tesco Ireland Ltd’s appeal and upheld a recommendation that a worker retain her paid half-hour lunch break. The decision was signed on 15 October 2014. Tesco said it had to change the worker’s schedule to comply with working-time rules requiring a one-hour lunch break for shop workers whose hours included 11.30am to 2.30pm. The worker’s union argued that her arrangements had been changed unilaterally and should be restored. The Court accepted that Tesco could alter her working pattern to meet the rules. It found, however, that a company letter dated 17 July 2003 protected the paid half-hour break in her terms and conditions. The recommendation also called for discussions on an attendance pattern that would preserve the break.
