Labour Court removes €1,000 recommendation to worker after Lufthansa appeal

The Labour Court upheld Lufthansa Technik Turbine Shannon’s appeal and removed a €1,000 payment recommendation to an unnamed worker after a transfer between areas of the plant. The union said the move reduced the worker’s overtime earnings and accepted the €1,000 recommendation as an appropriate resolution. The company said it followed agreed procedures, had legitimate business reasons for the transfer and did not consider compensation appropriate. The Court agreed with the Rights Commissioner’s findings, including that the transfer was not unreasonable in the context of investment and re-engineering, the selection criteria withstood scrutiny, and the worker’s income had fallen. It said those findings did not explain why compensation should be paid. The decision was signed on 8 October 2014.
