The Labour Court overturned a Rights Commissioner’s €2,000 recommendation to compensate a worker over his pay grade on promotion, upholding North Tipperary County Council’s appeal. The decision was signed on 7 October 2014. The Services Industrial Professional Technical Union argued that the worker should have received credit for nearly six years spent acting up as a General Services Supervisor before his permanent appointment. The Council said agreed procedures placed General Operatives promoted to that grade at the minimum point on its pay scale. The Court found the worker’s substantive grade while acting up was General Operative and that he was correctly placed at the minimum point under the applicable circulars. It noted the resulting inequity but found management had followed the agreed method, and set aside the recommendation.
