The Labour Court upheld the Rights Commissioner’s decision for Colm Wogan in his dispute with G4S Secure Solutions Ltd T/A G4S over his transfer from the Cadbury site. The decision was dated 11 August 2014.

Wogan, represented by the Services Industrial Professional Technical Union, said he followed the site manual when asked to train a new security officer. He said he sought relief cover and provided the training despite not receiving it. G4S said the transfer followed his refusal to train the officer and that staff could be moved to meet business needs. Wogan also alleged the transfer came after he raised workplace safety, health and welfare concerns; G4S denied this. His hourly rate was unchanged, but he lost the site allowance.

The Court found Wogan was entitled to fair procedure when an alleged failure to carry out his duties was being dealt with. It found he had not received those procedures before being disciplined by transfer, and upheld the Rights Commissioner’s decision as fair and reasonable.
