The Labour Court upheld the Rights Commissioner’s decision for Eoin Sheeran in his dispute with G4S Secure Solutions Ltd T/A G4S over his transfer from the Cadbury site. The decision was dated 11 August 2014.
Sheeran, represented by the Services Industrial Professional Technical Union, said he followed the site manual when asked to train a new security officer. G4S said the transfer followed his refusal to provide the training and that staff could be moved to meet business needs. Sheeran also argued that the transfer came after he raised workplace safety, health and welfare concerns. G4S denied this. Sheeran’s hourly rate remained unchanged, but he lost the site allowance.
The Court found Sheeran was entitled to fair procedure before being disciplined by transfer and that G4S failed to provide it. It upheld the Rights Commissioner’s decision as fair and reasonable.
