Labour Court declines to hear Jennifer Mitchell appeal

The Labour Court declined to hear Jennifer Mitchell’s appeal against a Rights Commissioner’s recommendation, finding it had no jurisdiction because she had retired by the time the dispute was referred. The decision was dated 4 June 2014; the merits were not decided. The Court said a retired person no longer active in the labour force was not a worker under the Industrial Relations Acts, so the dispute could not be a trade dispute within the Acts. The appeal was against HSE South.
