The Labour Court upheld a Rights Commissioner’s recommendation against a worker in an appeal over sick pay and removal from the payroll. Its decision was dated 4 June 2014. The worker, represented by the Irish Municipal, Public and Civil Trade Union, said she was treated unfairly after being removed from the payroll while absent from work and that sick pay was withheld. Galway County and City Enterprise Board said it followed its sick leave policy after she refused to attend a company doctor. The Rights Commissioner had found that she was required to attend the requested medical examination and made no recommendation in her favour. The Labour Court upheld that recommendation.
