Labour Court upholds recommendation against worker’s Injury Grant claim

The Labour Court upheld a Rights Commissioner’s recommendation against a worker’s claim for continued Injury Grant payments and rejected the worker’s appeal in a decision dated 19 May 2014. The worker, represented by Services Industrial Professional Technical Union, argued that the grant should continue if a phased return to work proved unsuccessful. HSE West said payment was no longer appropriate after the worker was certified fit to return on a phased basis. The Court found that the worker no longer met the payment criteria and that a delayed management letter did not justify failing to follow medical recommendations.
