The Labour Court dismissed a worker’s appeal against a recommendation rejecting her claim that a Clinical Nurse Specialist post at Tallaght Hospital should have been offered to her. The decision was dated 16 May 2014. The worker, represented by INMO, said her substantive post had been filled permanently during her career break and that the hospital later regraded another nurse without a transparent appointment process. Tallaght Hospital argued that no suitable vacancy existed and that the other nurse had met the recognised career pathway requirements. The Court found no basis to disagree with the Rights Commissioner’s conclusion that the regrading did not create a vacancy the worker should have filled, affirmed the recommendation and disallowed the appeal.
