The Labour Court found that a Meath County Council worker remained entitled to fill a vacant Senior Executive Engineer post until the seconded employee returned, the vacancy was filled through open competition or the post was suppressed. The decision was signed on 9 May 2014. The worker had held the acting role from January 2005 until February 2013 and sought regularisation after years in the post. He said that removing him from it had effectively demoted him. The council said regularisation required a confined competition and cited the Haddington Road Agreement.
