The Labour Court overturned a Rights Commissioner’s recommendation against a worker’s claim for compensation for lost overtime in a decision dated 20 May 2014. It recommended further examination of four missed evening overtime occasions under existing internal agreements, with compensation if those practices had been breached. The worker, represented by Services Industrial Professional Technical Union, said the council had cut rostered overtime, causing a claimed loss of €4,819.65. Cork County Council said other work had offset some of the loss and it could not pay for work the worker had not performed. The Court rejected the claim over a missed Galway trip because two trips to Birr offset that work. It made no recommendation at that point on two claims relating to morning overtime during the 2012 and 2013 tarring seasons, which it considered potentially collective.
