The Labour Court overturned a Rights Commissioner’s recommendation against an Irish Rail worker’s seniority claim. For redundancy purposes, the Court found his service would be calculated from 18 December 2000, when he joined the company. The decision was signed on 16 May 2014. The union appealed on the worker’s behalf, saying seniority could matter if Irish Rail introduced redundancies in future. Irish Rail argued that changing the calculation could undermine an earlier agreement about a colleague’s seniority. The Court said its finding would not disturb that arrangement.
