The Labour Court affirmed a Rights Commissioner’s recommendation that an HSE Dublin Mid Leinster worker receive an acting-up allowance at the Clinical Nurse Manager 2 rate. The decision was signed on 28 April 2014. The worker said she had been carrying out CNM2 duties since January 2012 and sought permanent appointment to the post. HSE Dublin Mid Leinster said she had been redeployed at her existing CNM1 grade and cited the recruitment embargo. INMO appealed the recommendation on her behalf. The allowance was recommended from 30 January 2012 until the post was properly filled. The Court noted management’s commitment that the worker held her current post permanently and affirmed the recommendation.
