The Labour Court set aside a Rights Commissioner’s recommendation that Cork County Council investigate a worker’s complaints and pay €3,000. The decision was signed on 28 April 2014. The worker, represented by the Services Industrial Professional Technical Union, said the council had not adequately investigated his complaints of alleged bullying and harassment. The council said it had investigated as far as possible and that the passage of time limited its ability to examine historical complaints. The Court directed the parties to agree on an independent person to investigate alleged incidents on or after 27 May 2010 set out in the worker’s letter of 26 June 2012, make relevant findings and recommend how the issues should be resolved. The process was to conclude within four months. The Court made no finding on whether bullying or harassment occurred.
