The Labour Court ruled that three workers at Mitie Facilities Management Limited were entitled to progress to the maximum point on their salary scale. Dated 3 April 2014, the decision followed the workers’ appeal against a Rights Commissioner recommendation on incremental pay. The Court found, on the balance of probabilities, that the workers had been employed on the salary scale presented to it. Mitie had argued that it could not apply the scales without a formally signed document and that the union could not identify who negotiated them. The Court set rates of €13.15, €13.68 and €14.36 for Mr AM and Mr SJ, with different effective dates; Mr SW’s rates were €13.15 and €13.68. Mr AM and Mr SJ were to receive their amounts due in two payments, while Mr SW was to receive the full amount outstanding at Easter 2014.
