The Labour Court upheld a €4,000 award to a worker after Noonan Services Group Limited appealed a Rights Commissioner’s recommendation. The decision was signed on 31 March 2014. The worker said Noonan’s refusal to let him return to his former site after a prolonged absence caused lost earnings. The company said he had refused to return unless he could choose where to work. The Court found the claim for payment covering February to July 2012 well founded and upheld the €4,000 award. It also found the former-site commitment was temporary and no longer enforceable after the worker’s six-year illness and changes in the business; his contract required him to be available to work at any company site.
