The Labour Court varied a Rights Commissioner’s recommendation after Trinity College Dublin confirmed that a six-month verbal warning had expired and been removed from a worker’s file. The decision was dated 2 December 2013. The Services Industrial Professional Technical Union had appealed on the worker’s behalf, seeking to have the sanction expunged. The union argued that the worker had not received fair procedures and that the employer’s inaction had caused the incident. The College said the worker had failed to identify a serious risk and that the verbal warning was the minimum sanction. The Court noted that the warning had expired and been expunged, and that the College would confirm this in writing. It considered the matter closed and varied the recommendation.
