The Labour Court increased compensation for an unfairly dismissed worker from €2,000 to €5,000, varying a Rights Commissioner’s recommendation on the worker’s appeal. The decision was dated 13 November 2013.
The worker appealed only the amount of compensation. Her employer, Denise Duggan, did not contest the appeal and did not attend the hearing. The Court accepted the worker’s uncontested submission that serious allegations made against her by the employer were groundless, and treated their unsupported nature as a serious aggravating factor.
The Court allowed the appeal and varied the recommendation, increasing the compensation to €5,000.
