Labour Court upholds permanent pensionable status for UCD worker

The Labour Court upheld a recommendation that a University College Dublin worker be recognised as a permanent pensionable employee, following the university’s appeal. The decision was dated 13 November 2013. The worker was a part-time Genealogy Teacher in Adult Education and had worked for nearly 20 years before receiving a permanent post in 2010. The university argued that pension wording in his contract was an administrative error and that his part-time role was not pensionable. The Services Industrial Professional Technical Union said the agreed contract could not be changed unilaterally. The Court found that the agreement and signed contract provided for a permanent pensionable post. It affirmed the Rights Commissioner’s recommendation that the university recognise that status from 1 May 2010 and disallowed the appeal.
