The Labour Court upheld a €5,000 recommendation for a worker whose overtime payments were withdrawn after Glanbia PLC Trading As Glanbia Consumer Foods Ireland appealed. The Court’s decision was dated 25 October 2013. The worker, a van driver/salesman based in Dungarvan, had received overtime after working more than 40 hours a week for more than four years. Glanbia said the payments resulted from a wages error and were not provided for in the worker’s contract. SIPTU argued that a collective agreement provided for overtime for actual hours worked and that the worker needed extra hours to service his routes. The Court found merit in the claim, upheld the Rights Commissioner’s recommendation of a once-off €5,000 payment and said the company’s appeal did not succeed.
