The Labour Court upheld a worker’s appeal, restoring her hours from 24 to 32 a week and awarding her €7,628.32 for lost income. The decision was signed on 19 August 2013. The worker, a special needs assistant at a school, said the procedure she could no longer perform was outside her duties and that seniority rules were breached when her hours were cut in September 2012. The school said the procedure was part of the job and it needed another assistant able to perform it. A Rights Commissioner had earlier found the claim not well founded. The Labour Court found the reduction unjustified and upheld the worker’s claims to have her hours restored and to receive compensation for lost income.
